Cookies Policy

Overview

  1. We are BOO Studio Pty Ltd (ACN 624 302 469 / ABN 13 624 302 469), trading as BOO Soft (“BOO Soft”, “we”, “us”, “our”). BOO Soft is the software arm of the BOO Group of companies. MopokeHQ is a BOO Soft product.

  2. This Cookies Policy applies to:

a. mopokehq.com (the marketing website, including the early-access, pricing, security and documentation pages);

b. app.mopokehq.com (the MopokeHQ application);

c. the BooAuth sign-in pages, to the extent described under “booauth.com” below; and

d. any other current or future MopokeHQ domains or subdomains (each a “Site”, together the “Sites”).

  1. This policy explains what cookies and similar technologies are, how and why we use them on the Sites, the choices available to you, and how those choices interact with your privacy rights. Read it together with the MopokeHQ Privacy Policy and the BOO Group Privacy Policy (see “Related Policies”).

  2. Cookies are small text files placed on your computer, phone or other device when you visit a website. They are widely used to make websites work, to make them work more efficiently, and to provide information to the site operator. For general information see https://www.allaboutcookies.org/.

  3. References to “cookies” include similar technologies such as local storage, session storage, web beacons, pixel tags and device identifiers where used for the same purposes.

  4. The mopoke CLI does not use cookies. It authenticates with an upload token you configure in your CI/CD environment and sends only the data described in the Privacy Policy.

  5. By continuing to use the Sites you confirm you have read this policy. We set no non-essential cookies. If we ever do, and applicable law requires prior consent (including in the EU and UK), we will ask for it first.

What Cookies We Use and Why

  1. We use cookies and browser storage only to:

a. sign you in and keep you signed in securely; and

b. remember your preferences, such as your theme and the project you last viewed.

  1. MopokeHQ does not use analytics, advertising, retargeting or marketing cookies, and does not sell or share personal information collected through cookies. Because we set only strictly necessary cookies and preference storage, we do not show a cookie banner. If this changes, we will update this policy and ask for consent before setting any non-essential cookie where the law requires it.

Cloudflare (both sites)

Both sites are served through Cloudflare. If Cloudflare challenges a request it suspects is automated, it may set __cf_bm (bot management, 30 minutes) or cf_clearance (a passed challenge, up to 1 year). These are strictly necessary for security and are not used to track you.

booauth.com (BooAuth sign-in pages)

Signing in to MopokeHQ takes you to BooAuth, BOO Soft’s identity service. The cookies BooAuth sets are described in the BooAuth Cookie Policy (https://booauth.com/cookies).

  1. Retention notes. Periods are maximums. A cookie or stored preference may be deleted earlier if you sign out, clear it, or your browser is set to do so.

  2. Browser storage stays on your device. Preferences in local storage are never sent to us.

  3. Where new cookies are introduced, we will update this policy and the tables above before they are set. Until that update is published, only the cookies and storage listed above are in use.

Your Choices and How to Manage Cookies

  1. No preference centre is needed. Every cookie we set is strictly necessary, so there is nothing to opt in or out of. You can still remove any cookie or stored preference through your browser.

  2. Browser controls. Most browsers let you view, delete and block cookies, including third-party cookies, and clear cookies on exit. See https://www.allaboutcookies.org/manage-cookies/. Settings apply per browser and per device.

  3. Do Not Track and Global Privacy Control. Where required by law (including for California residents under the CCPA/CPRA), we treat a Global Privacy Control signal as a valid opt-out of any “sale” or “sharing” of personal information through cookies. As we do not sell or share, this has no practical effect today, but we honour the signal. We do not otherwise respond to Do Not Track signals because no consistent industry standard exists.

  4. Effect of blocking cookies. Blocking Strictly Necessary cookies will prevent you from signing in to app.mopokehq.com. Blocking Functional cookies means preferences will not be remembered between sessions.

Third-Party Cookies and Service Providers

  1. Some cookies on the Sites may be set by service providers we engage (for example, Cloudflare for security and performance). These providers act as our processors and handle data on our instructions, or as independent controllers under their own privacy policies, depending on the service. Our providers are listed in the BOO Group Sub-processor list.

  2. We do not permit third parties to use cookies on the Sites to sell personal information or to build advertising profiles.

Cross-Border and Jurisdiction-Specific Information

  1. The Sites are operated from Australia and made available globally.

a. Australia. Our use of cookies is governed by the Privacy Act 1988 (Cth), the Australian Privacy Principles and, for direct marketing, the Spam Act 2003 (Cth). See the Privacy Policy for your rights and how to complain.

b. EEA and UK. Where the GDPR or UK GDPR applies, we rely on consent (Article 6(1)(a)) for non-essential cookies and on contractual necessity or legitimate interests (Article 6(1)(b) or (f)) for Strictly Necessary cookies. In line with the ePrivacy Directive and PECR, we set only cookies that are strictly necessary, which do not require consent. If that changes, non-essential cookies will be set only after consent, and you will be able to withdraw it at any time.

c. California, USA. Where the CCPA/CPRA applies, you have the right to opt out of the sale or sharing of personal information collected through cookies. We do not sell or share, and we honour Global Privacy Control signals.

d. Other jurisdictions. Where local law imposes specific cookie or electronic-communications consent requirements, we comply with them when setting cookies on devices in those jurisdictions.

  1. If there is a conflict between an applicable local law and this policy, the local law prevails to the extent of the conflict.

Children

  1. The Sites are not directed to children under 16 (or under 13 in the United States) and we do not knowingly use cookies to collect personal information from children. If you believe a child has provided personal information through the Sites, contact us.

Changes to This Policy

  1. We may update this policy to reflect changes to the Sites, the cookies we use or applicable law. For material changes we will give reasonable advance notice via a notice on the Sites or by email where we hold your details. The document date above shows the most recent update. Continued use after the effective date constitutes acceptance.

Governing Law

  1. This policy is governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction, without limiting any rights you have under mandatory consumer or data protection laws in your country of residence.
